Kalamazoo, MI Public Conduct: Outdoor Smoking Restrictions (2026)

Kalamazoo's outdoor smoking restrictions are narrower than a blanket public-space ban: they target specific posted zones rather than every park or sidewalk. Section 33-24.T, part of the 2018 Parks and Recreation article, prohibits smoking in any area of a City park, or at any event, that has been posted or otherwise designated as smoke-free, leaving the Parks and Recreation Department discretion to designate which spaces, such as playgrounds or event zones, carry that designation through signage. Subsection W of the same section makes a violation of any of the article's provisions, including the smoke-free designation, a misdemeanor unless another penalty is specified elsewhere.

A separate and older restriction, § 22-62, targets City-owned parking structures directly: it is unlawful to smoke or carry a lighted cigarette, cigar, or pipe anywhere in a parking ramp or structure the City owns, with a narrow exception for smoking inside a motor vehicle if all its windows and doors are fully closed. That section, amended in 1997 and again in 2022, makes a violation a municipal civil infraction rather than a misdemeanor, a lighter penalty track than the parks provision. Together the two sections show Kalamazoo regulating outdoor and semi-outdoor smoking through targeted, posted, or structure-specific bans rather than a general prohibition on smoking in every public outdoor space in the City.
