(b)Prohibited acts. It is hereby declared to be unlawful for any person knowingly or intentionally to possess, within the corporate limits of the city, marijuana as hereinabove described.(c)Penalties. Full Breakdown
Kenner Code of Ordinances § 7-191(a) defines marijuana as all parts of the Cannabis plant, whether growing or not, its seeds, and the resin extracted from it, along with every compound, salt, derivative, or preparation made from the plant, seeds, or resin. The definition excludes the plant's mature stalks, fiber made from those stalks, oil or cake made from the seeds, other preparations of the stalks or fiber, and sterilized seed incapable of germination, so hemp fiber and sterilized seed products fall outside the ban.
Subsection (b) then makes it unlawful for any person to knowingly or intentionally possess marijuana anywhere within the corporate limits of the City of Kenner, a citywide standalone municipal offense that applies regardless of quantity or location and exists separately from Louisiana's state marijuana statutes. Subsection (c) sets the penalty at a fine of not more than $500, imprisonment of not more than 60 days, or both, for anyone convicted. The ordinance, No. 9988, was adopted September 3, 2009, and the Code places it immediately alongside Section 7-192's separate ban on drug paraphernalia, adopted by companion Ordinance No.
9989 the same day. Because possession anywhere in the city is already unlawful, officers with the Kenner Police Department can charge public marijuana use or possession under this section without needing to show intent to sell or distribute.
Violations & Fines
Any person found holding, carrying, or otherwise possessing marijuana anywhere in Kenner, including sidewalks, parks, parking lots, or a vehicle, violates Section 7-191(b) regardless of the amount involved. Officers do not need to prove intent to distribute since simple possession alone is enough. Each incident is charged as a separate misdemeanor, and a Kenner city court may impose both the $500 fine and the jail term rather than only one.
