Section 605.230(A), part of the performance standards Ordinance No. 5485 added to the short-term rental chapter in March 2026, sets maximum occupancy at two persons per legal bedroom plus two additional persons, not to exceed ten occupants total, unless the Fire Marshal approves a higher count for that specific property. Because the cap is tied to legal bedrooms rather than advertised sleeping areas, a rental listed with extra sleeping space in a den or loft cannot count those areas toward a higher occupancy figure unless they qualify as legal bedrooms.

Subsection (H) requires the occupancy limit to be posted on every advertisement and listing alongside the registration number, parking instructions and quiet hours, so guests know the cap before they book. The occupancy standard works together with the life-safety requirements in Subsection (F), which call for smoke detectors, carbon monoxide detectors and at least one fire extinguisher per level, and with the registration checklist in Section 605.220 that already requires the owner to certify code-compliant egress and the number of bedrooms or sleeping areas up front.

Exceeding the posted occupancy limit is enforced under Section 605.240's escalating schedule, running from a written warning on a first violation to rising dollar fines for repeat violations within twelve months, and the City treats life-safety violations, which an occupancy overage bordering on unsafe crowding could implicate, as a major violation exposing the registration to suspension of up to ninety days or revocation of up to a year.
