Summary

Dublin requires a Temporary Exclusive Use Permit from the Parks and Community Services Director before anyone can claim exclusive use of a city park or recreation facility under Section 5.100.060. Permits carry conditions, fees, mandatory liability for any damage, and can require the permittee to carry insurance.

Park and recreation facilities designated by the Director shall be made available for the temporary exclusive use of persons subject to the issuance of a permit by the Director and subject to any reasonable conditions relating to the use thereof and/or the payment of any reasonable fees therefor as may be hereafter adopted by the city. ... A permittee shall comply with all park rules and regulations, and all applicable ordinances and laws. A permittee shall be liable to the city for any and all damage to parks owned by the city which results from the activity of the permittee. No permit for temporary exclusive use of any park shall be transferred without the consent in writing of the Director.

Full Breakdown

060, including 'any reasonable conditions' and 'reasonable fees' set by the city. 070 requires a permittee to comply with all park rules, ordinances, and laws, makes the permittee liable to the city for any damage to city parks resulting from their activity, and bars transferring the permit to anyone else without the Director's written consent. 080 lets the Director require the permittee to carry public liability and property damage insurance and to sign indemnification provisions to protect the park and the public. 090 separately bars unpermitted commercial activity in parks, such as teaching for a fee, advertising, or posting signs, unless the Director expressly authorizes it, which covers vendors and sponsors at a permitted event.

110(L), which require the Director's written approval of speaker number, location, power, and hours. The chapter traces to Ord. 16-88 and was most recently amended by Ord. 6-25.

Violations & Fines

Section 5.100.160 makes any violation of Chapter 5.100, including violating the terms of an issued permit, an infraction punishable as provided in Government Code Section 36900(b). Using a park facility for exclusive purposes without a permit, or breaching a permit's conditions, exposes the responsible person to that infraction citation in addition to liability for any resulting damage under Section 5.100.070.

Frequently Asked Questions

Do I need a permit for a birthday party in a Dublin park?
You need a Temporary Exclusive Use Permit under Section 5.100.060 only if you want exclusive use of a designated facility, such as a reserved picnic area or community room. General public use of open park space does not require one, but reserving space for your group does.
Am I responsible if my rented park facility gets damaged?
Yes. Section 5.100.070 makes the permittee liable to the city for any damage to city-owned parks that results from the permitted activity, separate from any fee already paid for the reservation.
Can I transfer my Dublin park permit to someone else?
No, not without the Director's written consent. Section 5.100.070 states that no permit for temporary exclusive use of any park may be transferred without that written approval.
