Hoboken, NJ Special Events & Permits: Parklets (2026)

Section 138-6 of the Hoboken Outdoor Dining chapter sets the construction and operating rules for curbside parklets built into former parking spaces. New parklet applicants, and businesses renewing for the first time after the chapter's 2022 adoption, must post a one-time maintenance bond of $15 per square foot with the City to cover removal or street repair if the licensee walks away; the City Engineer inspects the site before the bond is released. Under § 138-6G, a parklet cannot sit over a gas line, within 25 feet of a crosswalk measured from the nearest pavement markings, within 10 feet of a fire hydrant, or in a handicap space or loading zone.

Section 138-6K caps width at seven feet from the curb in a parallel parking lane or 14 feet in an angled lane, requires construction in seven-by-six-foot removable sections, bars lightweight materials like plastic sheeting or vinyl, and requires a safety barrier facing oncoming traffic; any roof cannot rise more than nine feet above the sidewalk. Effective April 1, 2025, § 138-1E requires the entire area underneath the platform to be accessible daily for cleaning, through hinged trap doors, an open base, or another design the City approves, and § 138-6N backs that with quarterly Division of Health inspections.

Fees under § 138-6I started at a $250 new-application fee and $100 renewal fee in 2022, plus a monthly user fee of $2.25 per square foot in 2022 rising to $2.50 in 2023, adjusted afterward by the Director of Transportation and Parking in line with parking meter rates.
