Hoboken, NJ Special Events & Permits: Sidewalk Dining & Cafés (2026)

The Hoboken City Council created the sidewalk cafe license under Chapter 138, Outdoor Dining, adopted March 9, 2022 by Ordinance No. B-441 and amended twice through February 19, 2025. A sidewalk cafe is defined at § 138-2 as sidewalk space beyond a restaurant's building line, which may extend in front of a qualifying neighbor's storefront. Under § 138-3, any restaurant, bar, distillery or brewery must file an annual application with the City Zoning Officer, supported by a diagram of tables and chairs, a litter and rodent-control plan referencing Chapters 110 and 136, proof of $1,000,000 per-occurrence liability insurance naming the City as an additional insured, written consent from the property owner if different from the applicant, and the application fee.

Section 138-5 sets the license term from January 1 to December 31 with no fee proration and no transfer between businesses. Effective January 1, 2022, the fee is $50 to apply plus a $2 per square foot annual user fee, raised to $2.25 per square foot on January 1, 2023. A pedestrian path at least six feet wide is required on sidewalks over 10 feet wide, or four feet on narrower sidewalks, and cafes on sidewalks 20 feet or wider may use the amenity strip along the curb with seating there capped at four feet wide.

Fixtures must come off the sidewalk each night except between Memorial Day and Labor Day, when barriers and furniture may stay out overnight but umbrellas and canopies must still be closed. No fixtures may be set up when snow blocks the required walking path, and no new holes may be drilled in the sidewalk for barrier fencing.
