Ramapo, NY Swimming Pools & Spas: Fencing & Safety Requirements (2026)

Section 376-64A requires that all in-ground swimming pools be encompassed within a permanent protective fence around the pool's entire perimeter. That fence must be structurally sound, durable, and kept in that condition, at least 48 inches high, with no more than three inches of space between the pickets, planks or linkage. Every entrance gate needs a self-latching device mounted at the top of the fence, and the gate must stay closed at all times except when someone is actually entering or leaving the pool area.

Subsection B gives above-ground pools a narrower exemption from the fencing requirement: they need no fence at all, but only if the pool is built so that, when it is unattended by someone of suitable age, the steps or ladder can be removed or raised so a child cannot climb up unsupervised. Subsection C puts the Building Inspector in charge of sign-off: every fence and every other safeguard used to satisfy § 376-64 must be approved by the Building Inspector of the Town of Ramapo in writing before it counts as compliant.

Because this is a Zoning Law provision, it reaches every in-ground and above-ground pool in the Town's unincorporated area; a pool inside Suffern, Spring Valley or one of Ramapo's other incorporated villages is regulated under that village's own pool-fencing rule, not Chapter 376.
