D.If any person fails to pay the charges authorized by this Chapter by the date they become due and payable, a penalty shall be added thereto. ... The penalty added by the exclusive franchisee for services billed by the exclusive franchisee will be two percent per month (or fraction thereof) of the delinquent amount.
