Full Breakdown

140(A) of the North Las Vegas Municipal Code restricts who may touch a solid waste or recyclables container once it is set out for pickup. No one other than the owner, the City, an exclusive franchisee, or their duly appointed agents may interfere with or remove solid waste or recyclables from containers intended for collection under the City's exclusive franchise program; tamper with, interfere with, or remove recyclables that have already been tied, boxed, or otherwise collected and placed out under the curbside recycling program; or otherwise participate in curbside residential recyclables collection at all.

Subsection (B) extends the same restriction to drop-off centers: only the center's owner, operator or authorized agents may remove recyclables from the center or from material that has been bundled, boxed, tied or otherwise collected and staged next to it. 080, which separately makes it unlawful for anyone but the City, its exclusive franchisee or their agents to collect or transport solid waste from residential or non-residential customers in the first place, so together the two sections shut out unlicensed haulers and scavengers from both hauling waste away and picking through what's already been set out. 370, enforced by the North Las Vegas Police Department, Fire Department and Code Enforcement.

Violations & Fines

Interfering with a set-out cart, pulling recyclables that have already been collected for curbside pickup, or hauling a customer's waste without being the City, the exclusive franchisee or an authorized agent is a Chapter 8.20 misdemeanor under § 8.20.370, carrying a fine of up to $1,000, up to six months in jail, or both, with each day of ongoing violation a separate offense. The City can also pursue an injunction under § 8.20.380 to stop repeat scavenging or unlicensed collection independent of any criminal citation.
