Village Code section 20-7-1 defines a 'dumpster' as any one cubic yard or larger container for the disposal of garbage or refuse. 6 of the Village's separate Zoning Ordinance. Subsection A requires owners, occupants, or responsible parties to arrange prompt, private garbage and litter collection not less than once each week. Subsection B sets a minimum capacity of at least one cubic yard of container space for every six units in a multi-family building. Subsection C allows containers larger than thirty two gallons only if they meet added safety specifications: adequate outriggers and other safety equipment, a minimum bottom width of at least thirty one inches for one-cubic-yard containers, proportionately wider bottoms for larger containers, and, for four-cubic-yard containers specifically, a maximum height of forty three inches with at least a four-piece lid opening.
Subsection E separately requires that non-operating refrigerators and similar equipment not be discarded, abandoned, or stored on the premises without first removing the doors, a rule aimed at preventing entrapment hazards around dumpster and storage areas.
Violations & Fines
Failure to meet the container-size, capacity, or safety-equipment standards of section 20-7-3, like other Article 7 violations, is enforceable by citation from the Police Department, Housing Division, Building and Zoning Division, Health Department, or Public Works Department under section 20-7-19. A cited violator can avoid prosecution by paying $125.00 to the Village within ten business days of the citation, but the maximum penalty for a prosecuted violation of the article is $750.00 under section 20-7-20.
