Oak Park, IL Trash & Recycling: Illegal Dumping (2026)

Village Code section 20-7-11 makes it unlawful for anyone to deposit litter anywhere in the Village except in an authorized receptacle, and separately bars depositing litter in any gutter, street, alley or other public place; it also puts an affirmative duty on property owners, operators and occupants to keep the sidewalk and parkway in front of their premises free of litter. Section 20-7-8 goes further for private land: letting garbage or litter accumulate on any premises, outside the routine storage and collection scheme in sections 20-7-2 and 20-7-3, is itself declared unlawful and a nuisance.

When that happens, section 20-7-9 lets the Director act: after serving the owner, operator or occupant forty-eight hours' written notice, with the last person to pay real estate taxes on the property treated as the owner for this purpose, the Director can have the Village remove the accumulated garbage or debris if the responsible party still hasn't acted, then bill the removal cost to them. If that bill goes unpaid, section 20-7-10 lets the Director file a notice of lien with the Cook County recorder of deeds, or the registrar of titles for Torrens-registered land, within sixty days of incurring the cost; the Village can foreclose that lien like a mortgage, and has two years from filing to sue. None of this blocks the Village from also filing a criminal complaint for the underlying littering or dumping violation.
