La Habra, CA Trash & Recycling: Recycling Rules (2026)

La Habra Municipal Code § 8.04.140, part of Chapter 8.04 (Solid Waste Collection and Disposal, effective January 1, 2022 under Ord. 1838), makes it unlawful for anyone besides the city's contracted franchisee to collect refuse, green waste, organic waste or recyclable materials from a premises in the city, place a collection bin, or transfer and remove those materials, unless that person has signed an exclusive franchise agreement with the city. Each day a violation continues counts as a separate offense, so a hauler running unlicensed recycling routes for a week can rack up seven distinct violations rather than one.

Section 8.04.150 carves out limited exceptions: a resident may sell or donate source-separated recyclables directly to a buyer other than the franchisee, personally haul their own solid waste to a processing facility, or use a licensed construction/demolition contractor's dump trucks for debris removal. Landscapers who remove green waste as an incidental part of a broader service, and government agencies operating in their own capacity, are also excluded from the franchise requirement. Enforcement runs through § 8.04.360: the city enforcement official (city manager or designee) or a regional/county agency official issues a notice of violation giving sixty days to comply, and unresolved cases move to civil, criminal or administrative citation under § 1.20.050.

Public Works additionally has authority under § 8.04.260 to tag and impound any solid waste container found on a route without a franchise agreement. Section 8.04.140 keeps La Habra's blue-container recycling stream tied to a single accountable contractor rather than a patchwork of independent scrappers.
