Section 8.04.120 governs when a residential trash, recycling or green waste cart may sit at the curb, in the alley or in the public right-of-way. Containers cannot go out earlier than four p.m. on the day before the scheduled pickup, and residents must bring them back in no later than noon on the day following collection, so a cart cannot legally sit street-side for more than roughly twenty hours around the actual pickup. The rule sits within Article I of Chapter 8.04, the same article that requires containers to stay clean, tightly covered except when in use, and free of leaks under § 8.04.180, and that lets the franchisee tag a noncompliant container as condemned.

Enforcement of the placement window runs through § 8.04.360, the chapter's general enforcement section, which authorizes a notice of violation followed by an administrative citation if the resident does not correct the timing after notice. The public works director also holds separate authority under § 8.04.260 to tag and, after twenty-four hours, impound any solid waste container that is not a franchisee-approved container placed in violation of the chapter, which is a distinct process from the routine early-or-late placement violation addressed here.
