Laguna Niguel Municipal Code has no breed ban. Dangerous and vicious dogs are regulated by behavior under Article 6 (Sections 10-1-94, 10-1-95), not by breed. California Food and Agricultural Code Section 31683 also bars any city from declaring a dog dangerous or vicious based solely on its breed.
Laguna Niguel has no breed-specific legislation. Title 10, Article 6 regulates dangerous and vicious dogs by conduct. Section 10-1-23 defines a 'vicious dog' as one that inflicts severe injury on or kills a human, one that continues potentially dangerous behavior after notice, or one deemed vicious by another jurisdiction, none referencing breed. 'Dangerous animal' (Section 10-1-5) means any animal presenting a threat as determined by the director; declaration rules are in Section 10-1-95. This conduct-based approach is required by California Food and Agricultural Code Section 31683, which lets cities regulate dangerous dogs but prohibits any breed-specific rule. State law does allow breed-based mandatory spay/neuter programs (Section 31683; Health and Safety Code Section 122331), but Laguna Niguel has adopted none.
There are no breed-based penalties. A dog of any breed found vicious or potentially dangerous under Sections 10-1-23, 10-1-5, and 10-1-95 may face confinement conditions, impoundment, or other control requirements imposed by the director, enforceable through Title 10.
