Laguna Niguel, CA Animal Ordinances: Pet Store Rules (2026)

Section 10-2-418(a) prohibits a pet shop or retail pet store from selling, delivering, offering for sale, bartering, auctioning, or otherwise disposing of a cat, dog, or rabbit, except under four narrow carve-outs in subsection (b): sales by a publicly operated shelter, animal control agency, rescue, or nonprofit humane society; a store hosting an animal shelter's or rescue's adoption offering as long as the store takes no fee or ownership stake; adoption events where the store receives no payment from the sale or for use of its space; and animals sold directly from the premises where they were born and reared, or through a breeder, so long as the transaction bypasses a pet shop or retail store.

This is a straightforward puppy-mill ordinance: retail stores are pushed into an adoption-only model rather than being banned from operating altogether. Section 10-2-419 backs the sale ban with a recordkeeping mandate, requiring every pet shop to document the source of each dog, cat, or rabbit it acquires for at least a year and produce those records immediately to police, code enforcement, animal control, or humane law enforcement officers on request; the city or county may also inspect the premises during regular business hours. Section 10-2-420 separately declares a violation both unlawful and a public nuisance, opening the door to civil abatement, removal, or injunction actions by the city attorney in addition to any citation.
