Summary

Doral confines adult bookstores, theaters, entertainment clubs and video stores to the industrial district and, under Sec. 74-556, keeps them 1,000 feet from schools, churches, parks, libraries and day care centers, 1,200 feet from each other, and 750 feet from any residential zoning district.

(a)Unless approved as a special exception, none of the uses set forth in section 74-555(b) shall be permitted as follows:(1)Within 1,000 feet of a private school as defined in section 74-318, public school, church, public park, public library, day care center or nursery for children;(2)Within 1,200 feet of any of the uses described in section 74-555(b); and(3)Within 750 feet of any residential zoning district.(b)Spacing requirements in subsection (a) of this section shall not apply where the adult entertainment use is separated from the uses set forth in subsection (a) of this section by a county or state road of not less than six lanes, or an expressway. All other distance and spacing requirements pursuant to this Land Development Code shall apply, as well as those spacing requirements imposed by state statute, if such state spacing requirements are more restrictive than the regulations contained herein. Any application seeking a variance from the state imposed spacing requirements shall be heard directly by the city council.

Full Breakdown

Sec. 74-555 permits only the industrial district to host adult bookstores, adult theaters, adult entertainment clubs and adult video stores; no other zoning district in the city allows these uses. Sec. 74-556 then layers three separate buffers on top of that district limit. First, an adult use cannot sit within 1,000 feet of a private school, public school, church, public park, public library, day care center or children's nursery. Second, it cannot sit within 1,200 feet of any other adult use listed in Sec. 74-555(b), preventing clustering.

Third, it cannot sit within 750 feet of any residential zoning district boundary. Distances are measured under Sec. 74-557 as a straight line from the nearest point of the proposed place of business, including its patron parking lot, to the nearest point of the protected use or district boundary. The buffers do not apply where the adult use is separated from the protected use by a county or state road of at least six lanes, or by an expressway; every other spacing rule in the Land Development Code, plus any stricter distance imposed by state statute, still applies.

An operator seeking relief from a state-imposed spacing requirement, rather than the city's own buffers, must take that request directly to the city council rather than through the standard special exception process. Sec. 74-558 exempts accredited educational and cultural institutions, museums and commercial photography studios using nude subjects.

Violations & Fines

Operating one of the Sec. 74-555(b) adult uses outside the industrial district, or inside the 1,000-foot school/park/church buffer, the 1,200-foot use-to-use buffer, or the 750-foot residential buffer without an approved special exception, is a Land Development Code violation subject to code enforcement citation, denial or revocation of the certificate of use, and referral to the special magistrate for an order to cease operation.

Frequently Asked Questions

Where in Doral can an adult bookstore or club legally operate?
Only in the industrial district under Sec. 74-555, and only if the site clears the buffers in Sec. 74-556: 1,000 feet from schools, churches, parks, libraries or day care centers, 1,200 feet from any other adult use, and 750 feet from any residential zoning district.
Can two adult businesses locate near each other in Doral?
No, not within 1,200 feet of one another under Sec. 74-556(a)(2), unless the city council approves a special exception; the buffer is designed specifically to prevent clustering of adult bookstores, theaters, clubs and video stores.
Is there any way around the spacing buffers?
Sec. 74-556(b) waives the buffers only where a county or state road of at least six lanes, or an expressway, separates the adult use from the protected use or district; every other Land Development Code distance rule, and any stricter state spacing statute, still applies on top of that exception.
