Doral, FL Business Licensing & Operations: Tobacco Retail License (2026)

Section 74-170 targets any commercial establishment where 20 percent or more of the floor space is dedicated to selling tobacco products, vapor-generating devices, smoking devices, consumable hemp or CBD products; the code labels this a 'tobacco/vape/consumable hemp/CBD dealer' and expressly excludes cigar/hookah bars, grocery stores, gas stations and convenience stores from that definition. Any qualifying dealer, whether a permanent storefront or a kiosk, truck, van or other transportable shelter, must sit at least 2,500 feet from an education facility serving kindergarten through 12th grade (colleges, universities and trade schools are exempt from this spacing rule) and at least 2,500 feet from a place of worship.

A second, tighter rule keeps competing dealers apart: no such business may open within 1,200 feet of another tobacco/vape/consumable hemp/CBD dealer. All three distances are measured the same way, by the shortest roadway path from the front door of the proposed dealer to the nearest point on the property boundary of the school, place of worship or existing dealer, not as a straight line. Applicants must submit a scaled survey prepared by a registered land surveyor to prove compliance with these separations before the city will approve the location; the planning director or a designee can waive that survey requirement only by written certification that the minimum distance separation has already been satisfied.

The section was adopted by Ord. No. 2023-20 on August 23, 2023, and amended by Ord. No. 2024-07 on March 20, 2024. A separate, newer section, 74-171, imposes its own 500-foot spacing rules for Kava and Kratom establishments; that is a distinct provision from the tobacco/vape/hemp/CBD spacing rule in Sec. 74-170 and covers a different set of products.
