South Fulton regulates tobacco and vape retailers as smoke shops under chapter 5 of title 2, treating the business as a privilege rather than a right under Sec. 2-5020. Sec. 1(a) prohibits any establishment from selling, displaying, distributing, delivering, offering, furnishing, or marketing tobacco or tobacco products, whether natural or synthetic, including cigarettes, cigars, pipe tobacco, electronic smoking devices, and tobacco accessories or paraphernalia, within one mile of any school building, educational building, daycare, or school grounds. Sec. 1(b) backs the ban with a licensing bar: no business license will be issued for a location that falls inside the one-mile buffer.

Under Sec. 1(c), any applicant must simultaneously apply for the city's special use permit under section 803 of the zoning ordinance.
