Tamarac, FL Business Licensing & Operations: Tobacco Retail License (2026)

City Code Sec. 13-25, enacted by Ordinance No. O-2019-22 on December 11, 2019, regulates retail sale of vaping products throughout the City of Tamarac. The section defines an 'electronic nicotine dispensing device' broadly to include e-cigarettes, e-cigars, e-pipes, hookah pens and any similarly named product, whether or not it is currently loaded with liquid nicotine, and separately defines a 'nicotine product' as any nicotine-containing item intended for human consumption other than a tobacco product regulated under F.S. § 569.002 or an FDA-regulated drug device. Subsection (b) makes it unlawful for any person to sell, gift, deliver or otherwise transfer such a device or product, including imitation-name items like 'liqweed' or 'hash oil e-juice,' to anyone under 21, and requires ID checks for any purchaser who does not obviously appear older than 30.

Subsection (d) requires every retailer to post a sign, in letters at least one-half inch high, stating that sale to persons under 21 is against City of Tamarac law and that proof of age is required; removing that sign is itself a separate violation. Subsection (f) delayed enforcement for six months after adoption to give retailers time to comply. Any city law or code enforcement officer may enforce the section and may seize devices or products as evidence. Penalties under subsection (g), cross-referenced to Sections 2-73.07 and 2-73.08, run up to $250 per day for a first occurrence and up to $500 per day for each additional occurrence, with every prohibited sale treated as a separate violation.
