La Habra bans ALL fireworks, including California-legal 'safe and sane' varieties. Under La Habra Municipal Code (LHMC) Chapter 9.22 it is unlawful and a public nuisance to possess, store, sell, use, or explode any fireworks. The only exception is a permitted supervised public display approved by the Chief of Police.
LHMC 9.22.010 (Ord. 1317, 1987) makes it unlawful to possess, store, offer for sale, sell at retail, use, or explode any fireworks. The definition of 'fireworks' expressly includes both 'dangerous fireworks' and 'safe and sane' fireworks as defined in the California Health and Safety Code, so state-approved items sold in some neighboring cities are also illegal here. The Chief of Police may permit supervised public displays by a jurisdiction, fair association, amusement park, or other organization using competent operators. Fire enforcement is provided under contract by the Los Angeles County Fire Department (Consolidated Fire Protection District), not OCFA.
Violations are punishable under LHMC Chapters 1.08 and 1.20. Misdemeanor citations under Chapter 1.08 carry a fine up to one thousand dollars ($1,000). Fireworks are a public nuisance subject to abatement, and items may be seized and destroyed.
