Lake Elsinore, CA Fire Regulations: Fireworks (2026)

Chapter 8.52 FIREWORKS applies citywide and treats even the "safe and sane" fireworks that some California cities allow around July 4th as prohibited. Section 8.52.030(A) makes it unlawful for any person to possess, keep, store, use, shoot, discharge, ignite, explode, manufacture, sell, offer to sell, give or transport fireworks, dangerous fireworks or safe and sane fireworks, with narrow exceptions for agricultural and wildlife fireworks or a permitted public display under California Health and Safety Code Sections 12640 through 12654. Notably, a property owner or person in control of property who allows fireworks to be sold, used, discharged or possessed there is liable regardless of intent, knowledge or negligence, since Section 8.52.030(A) expressly makes the offense strict liability.

Manufacturing fireworks is separately barred by Section 8.52.030(B) absent a special State and City permit, and pyrotechnic special effects material used in film, television or stage productions needs its own permit from the Fire Chief and Sheriff under Section 8.52.030(C), issued only to a State-licensed pyrotechnic operator. Public displays require a permit application filed with the Fire Chief and Sheriff at least 14 days ahead under Section 8.52.040, including a site diagram, pyrotechnic-operator supervision, and a bond or insurance covering potential damages. The Fire Chief and Sheriff may seize and dispose of any fireworks found in the city and can bill the owner for transport, storage and disposal costs.
