Laguna Niguel does not have a separate local smoke alarm ordinance; state law under California Health and Safety Code Section 13113.7 and the California Residential Code apply. Smoke alarms must be installed inside each bedroom, immediately outside each sleeping area, and on every story, including basements and habitable attics. Since July 1, 2014, any battery-only smoke alarm sold or installed in California must have a non-removable battery lasting at least 10 years, and alarms should be replaced 10 years from their manufacture date. For rentals, the property owner must test, maintain, and ensure the required alarms are present. Because much of Laguna Niguel lies in a Very High Fire Hazard Severity Zone, working alarms are an essential defense.
A violation of Health and Safety Code Section 13113.7 is an infraction punishable by a fine of up to $200 per offense; landlords who fail to maintain alarms may face additional habitability claims.
