Section 3-12.5 makes it unlawful to produce noise received on another's property above the ambient base levels, measured as A-weighted decibels. R-1 and R-2 zones are 60 dBA during day (7 a.m.-7 p.m.), evening (7-10 p.m.) and night (10 p.m.-7 a.m.). R-3 is 60 dBA day and evening but 55 dBA at night. Commercial zones are 65 dBA day and evening and 60 dBA at night. Manufacturing is 75 dBA at all times. At a boundary between two zones, the quieter zone's limit applies. Measurements are taken at the receptor's property line, about 10 feet from any obstruction, averaged over a 15-minute period per Section 3-12.4.
Exceeding the Section 3-12.5 limits is a violation enforced as a misdemeanor under Section 1-5 or an infraction. Machinery, radios and amplified sound have separate over-ambient thresholds. Each violation is a separate offense (Section 3-12.19).
