Casper, WY Public Conduct: Outdoor Smoking Restrictions (2026)

Casper Municipal Code Section 8.16.040(A) prohibits smoking in the enclosed areas of a long list of public places, from restaurants and bars to shopping malls and sports arenas. Subsection (B) extends the ban outdoors for one category specifically: smoking shall be prohibited in or on all City-owned youth athletic facilities, defined in Section 8.16.020 to include facilities for youth soccer, baseball or skateboarding whether enclosed or not. Section 8.16.060 adds a citywide buffer rule: to keep secondhand smoke from drifting indoors, every person who is smoking must smoke at least ten feet from all public entranceways, passageways, operable windows or ventilation systems of any enclosed area where smoking is prohibited.

Section 8.16.080 then carves out outdoor exemptions from the enclosed-area rules, including outside patios, provided any sliding, folding or other windows or doors bordering the patio stay closed to prevent smoke migration into the enclosed space, and the outside areas of public and private golf courses. If a patio's doors or windows do not actually block that migration, the patio is treated as an extension of the enclosed area and the indoor ban applies there too. Enforcement runs through the Casper Police Department under Section 8.16.110, and the fire chief, defined as the head of Casper Fire-EMS, can also restrict smoking under Section 8.16.090 wherever fire safety requires it. The definition of smoking under Section 8.16.020 includes vaping and electronic smoking devices throughout the chapter.
