Casper, WY Public Conduct: Public Alcohol Use (2026)

Section 5.08.480 defines an open container as any glass, cup, bottle, can or other vessel other than the beverage's original unopened package, and defines open space as any street, alley, public way, sidewalk, or unenclosed public or private parking lot, expressly excluding golf courses. It bans selling alcohol through a drive-up window for off-premises consumption, bans operating a vehicle with an open container anywhere accessible to driver or passenger, and separately bans possessing or consuming from an open container inside a vehicle at all. Possession in open space or in listed structures is unlawful unless the city manager has issued a license or permit, though the council may by resolution create special districts between the Friday before Memorial Day and Labor Day where possession is temporarily allowed.

A narrow carve-out lets a passenger of legal age drink inside a for-hire commercial vehicle seating five to fourteen adults if a partition or five feet separates the driver, and no occupant is under twenty-one. Section 5.08.490 separately criminalizes public intoxication on any street or public place, sleeping or unconscious in public, trespassing while intoxicated, or being turbulent or disorderly. Section 5.08.530 makes a Chapter 5.08 violation a misdemeanor punishable by up to a seven-hundred-fifty-dollar fine, enforceable under Wyoming Statutes Section 12-1-101 et seq., and requires the citing agency to notify the city clerk within five business days.
