Hoboken, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

City Code § 46-10, adopted for Article II of Chapter 46, first requires compliance with the New Jersey Smoke-Free Air Act, N.J.S.A. 26:3D-55 et seq., at all times on City property or inside City buildings, then adds Hoboken-specific outdoor rules. Subsection B bans smoking inside all buildings owned, rented or leased by the City. Subsection C creates a 25-foot outdoor buffer: smoking is prohibited within 25 feet of any entrance to, or air intake duct on, any building the City owns, rents or leases, a rule amended in 2021 and again in 2022 to its current form.

Subsection D extends the ban to any outdoor courtyard or atrium on City-owned, rented or leased property, closing off open-air spaces that sit within a municipal building's footprint even if more than 25 feet from a doorway. This buffer-zone rule is distinct from the flat cannabis and tobacco smoking ban inside City parks under § 58-21GG: § 46-10 targets outdoor space immediately surrounding City buildings such as City Hall or the library, while the park ban covers park and recreation land generally. Enforcement of Article II runs through the City's Health Officer or Officers together with the Hoboken Police Department under Subsection E, giving both a health-code and a police-power route to a citation.
