Hoboken, NJ Public Conduct: Public Urination (2026)

Section 145-22 is a single-sentence prohibition: no person may urinate in any street, highway, thoroughfare or public place within the City of Hoboken. The provision has stood since it was amended by Ordinance No. V-140 on November 4, 1987, and again by Ordinance No. R-7 on October 20, 1993, both of which also updated the citywide penalty clause that now governs it. The rule sits inside Chapter 145, Peace and Good Order, a catchall chapter of nuisance and public-order offenses that also bans vagrancy, indecent exposure and gambling devices, so a public urination charge is enforced alongside those neighboring offenses by the Hoboken Police Department.

There is no carve-out in the text for private establishments that lack restroom access or for any other circumstance; the ban applies anywhere within the street, highway, thoroughfare or public-place categories the section names. Penalties are set citywide for the whole chapter by § 145-26: upon conviction, a violator faces imprisonment in the county jail or another municipal detention facility for up to 90 days, a fine of up to $2,000, a term of community service of up to 90 days, or any combination of those three the Municipal Court chooses to impose.

Because § 145-26 was last amended in 2010 (Ordinance No. Z-28), the $2,000 ceiling and 90-day terms reflect the current, currently enforced maximums rather than the lower fines set when § 145-22 was first written. Officers issue a municipal summons for the offense, and the case is heard in Hoboken Municipal Court rather than through any administrative citation process, meaning a defendant can contest the charge before a judge.
