Full Breakdown
Section 145-23, added in 1993 and most recently amended May 15, 2024 by Ordinance No. B-665, splits the open-container rule into two prohibitions. Subsection A bars possessing an opened container of any alcoholic beverage, in a glass, bottle, can or any other container, on a public street, highway, avenue, alley or road, on public grounds, parks, sidewalks or marine basins, in the common areas of the Hoboken Housing Authority, or inside any automobile or other vehicle located on those public spaces. Subsection B separately prohibits the act of drinking: no person may serve, sell, dispense, drink or consume an alcoholic beverage in any of those same public locations.
The ordinance defines COMMON AREAS broadly to include entrances, hallways, stairways, elevators, laundry and recreational rooms, playgrounds, courtyards, community centers, garages, parking lots and boundary fences of residential property used by more than one dwelling unit, meaning the ban reaches shared spaces at Housing Authority buildings, not just city streets. A near-identical prohibition also appears at § 68-13 within Chapter 68, Alcoholic Beverages, which the City enacted separately in 1973 and which carries the same penalty structure. Section 145-23 sits in Chapter 145, Peace and Good Order, and its penalties are set by the chapter-wide § 145-26 rather than by its own separate clause.
A conviction can bring imprisonment in the county jail for up to 90 days, a fine of up to $2,000, up to 90 days of community service, or any combination the Municipal Court Judge chooses. Officers may issue a summons for open containers even without proof that a person was actively drinking, since possession alone violates Subsection A independent of consumption under Subsection B.
Violations & Fines
A conviction under § 145-23 is penalized through the chapter-wide clause at § 145-26: up to 90 days in the county jail, a fine of up to $2,000, up to 90 days of community service, or any combination, at the Municipal Court Judge's discretion. Police can cite for possession of an open container alone, without needing to prove active drinking.
