Hoboken, NJ Public Conduct: Skateboarding Rules (2026)

Article XXIV of the Hoboken traffic code, "Hazardous Recreational Activities," adopted 7-1-1996 as Ord. No. R-194, targets skateboards, roller skates, in-line skates and motorized scooters together. Section 190-40B is the operative ban: "No person shall engage in the reckless operation of roller skates, in-line skates, a skateboard or a motorized scooter." The code defines RECKLESS OPERATION broadly to cover operating any of these devices on a public street, highway or sidewalk in a manner that causes harm to the safety or property of another, and it spells out three specific examples: holding onto a moving object such as a car while skating, failing to ride as near to the right side of the roadway as practicable, and failing to exercise due care when passing vehicles or people, turning, or stopping.

The definitions section also defines SIDEWALK, SKATEBOARD, ROLLER SKATE and IN-LINE SKATE by their physical construction, so the ban reaches manufactured skate and skateboard devices regardless of brand. Each violation is treated as "a separate traffic infraction," and § 190-40C sets the penalty at not less than $50 nor more than $100, or imprisonment not exceeding five days, or community service not exceeding 100 hours, or any combination of the three. Section 190-40D assigns enforcement to the Hoboken Police Department rather than to code enforcement or parking staff, underscoring that this is treated as a public-safety infraction rather than a parking or nuisance matter.

A companion provision, § 190-40.1, addresses liability for participation in a hazardous recreational activity generally, but the reckless-operation ban itself applies citywide to any public street, highway or sidewalk, including Hoboken's commercial corridors along Washington Street.
