The definition of 'smoking' in Sec. 50-211 covers cigarettes, cigars, pipes, hookahs, and any lighted or heated tobacco or plant product including marijuana, plus electronic smoking devices that create an aerosol or vapor. One outdoor carve-out exists: under Sec. 50-212(b)(5), the outdoor area of a place of employment is not automatically smoke-free, except within the 25-foot government-building buffer, unless the business owner posts signs declaring that outdoor area off-limits to smoking, at which point it becomes a smoke-free zone under the article. 50-213 wherever smoking is prohibited, and ashtrays must be removed from those areas. The article took effect August 8, 2020, under Ord. No. 51, 2020, with later amendment dates for gaming floors and riverboats.
Violations & Fines
Enforcement runs by citation under Sec. 50-214: a first offense under most of the outdoor and indoor prohibitions in Sec. 50-212(a)(1) through (a)(4) is a $25.00 fine, a second offense is $50.00, and a third or subsequent offense is $100.00. Employers who knowingly permit smoking in a covered enclosed area face steeper fines: $100.00 for a first offense, $250.00 for a second offense in the same year, and $500.00 for a third or subsequent offense in the same year.
