Chapter 9.28 PUBLIC CONSUMPTION OF ALCOHOLIC BEVERAGES defines "alcoholic beverage" broadly in Section 9.28.010 to include alcohol, spirits, liquor, wine or beer containing one-half of one percent or more alcohol by volume. Section 9.28.020 then bars drinking or attempting to drink any alcoholic beverage while in or upon a public park, street, alley, highway or other public place, except where drinking is expressly permitted by law, such as a City-authorized special event. Section 9.28.030 extends the ban to furnishing or giving alcohol to someone else with the intent that they drink it in a public place, unless the City Council or another legal exception applies, and Section 9.28.040 separately bans exhibiting or displaying alcoholic beverages in an indecent or offensive manner in those same public places.

Section 9.28.050 declares that violating Sections 9.28.020 through 9.28.040 is a menace to public safety, injurious to health, indecent and an obstruction of the community's enjoyment of public property, language the city can point to in nuisance and civil enforcement. The chapter also flags that California Vehicle Code Section 23121 separately forbids drinking any alcoholic beverage inside a motor vehicle on a highway, a state law layered on top of the city's public-place ban.
