Rocklin, CA Public Conduct: Public Marijuana Use (2026)

Chapter 8.34, adopted after Proposition 64 in 2016 by Ordinance Nos. 1058 and 1059, applies only to property owned, leased, rented or controlled by the City of Rocklin, expressly excluding private property under Section 8.34.010. Section 8.34.040 defines "public property" broadly to include streets, sidewalks, parks, city facilities, open space, bike and walking trails, and recreation and sports areas, and defines "smoking" to reach both combustible marijuana and vaporizing e-cigarette-style devices. Section 8.34.050 prohibits smoking or use of marijuana in any form on that public property, including at any special event or activity, which must be conditioned to comply.

Section 8.34.060 explains the city's rationale: state Proposition 64 barred marijuana use in a "public place" without defining the term, so Rocklin wrote its own definition covering city streets, sidewalks, public property, recreation areas and sports arenas. Enforcement under Section 8.34.070 is not limited to the police department; the fire marshal or a designee and the city's code enforcement officers can also cite violations, and notice of the rule must be given to anyone applying for a special event permit on public property. Section 8.34.080 makes a violation an infraction with an escalating fine schedule and separately declares a violation a public nuisance that can be abated through civil action, independent of the criminal fine.
