Section 5.02.030 requires both a solicitor and the person or business they solicit on behalf of to hold valid solicitation permits and a business license under Chapter 5.08 before engaging in commercial solicitation, even if exempt from license fees. Solicitors must carry photo identification and a copy of their permit at all times and present it immediately to anyone approached or to a law enforcement officer on request. Under Section 5.02.040, a commercial applicant files with the City Clerk at least 30 calendar days before soliciting, submits proof of LiveScan fingerprinting completed at the police department, a 10-year employment history, disclosure of any criminal convictions or pending cases, proof of insurance, and pays a fee set by City Council resolution.

Section 5.02.050 requires the Orange County Sheriff's Department, acting as the City's police department, to run a criminal history background check, and Section 5.02.050(E) disqualifies any applicant with a conviction for violent crime, sexual assault, controlled substance possession, theft, fraud or burglary. Commercial permits under Section 5.02.060 are valid up to six months and renewable; the City Manager may revoke a permit for false information, noncompliance, a related conviction, or conduct detrimental to public health, safety or welfare, and a revoked applicant cannot reapply for one year. Denials and revocations may be appealed to the City Council within 15 calendar days under Section 5.02.070.
