San Clemente carts must be placed at the curb or alley no earlier than 5:00 p.m. the day before collection and removed within 24 hours after pickup, then stored substantially hidden from public street or alley view under SCMC 8.28.040.
SCMC Section 8.28.040 governs container placement. Customers place carts and scheduled bulky items adjacent to the curb in front of their premises, or, where there is no curb, adjacent to the main traveled street or in the rear alley; premises with alley access must use the alley. Containers and bulky items must be grouped together and set out 'no earlier than 5:00 p.m. of the day prior to the day fixed for collection.' Within 24 hours after collection they must be removed and stored 'substantially hidden from view from any public street or alley,' meaning behind a permanent wall or fence not less than the container's height. Carts may not be overfilled so the lid cannot close (SCMC 8.28.020(C)).
SCMC 8.28.040 allows a first violation to draw a warning sticker or mailed notice, but the City may cite without warning. Citations under SCMC 8.28.210(C) are $50, $75, then $100 under Chapter 1.20.
