Under Alameda Municipal Code Sec. 1(a), the occupant or owner of any premises where solid waste is created must dispose of it at least once each week through the collection service of the city's exclusive franchisee, paying rates the franchisee sets within City Council-approved ceilings. Subsection (b) makes enrollment in recyclable-materials and organic-materials collection equally mandatory, unless the customer qualifies for an exemption under Sec. 4, such as the vacancy exemption for premises vacant thirty days or the disabled-person backyard-service accommodation. Each customer must arrange with the franchisee for enough containers to hold everything generated between pickups; if the City Manager determines a customer's container capacity is inadequate, the owner has fifteen days from written notice to add capacity.
Should an owner or occupant simply never sign up, Sec. 1(d) lets the City Manager start collection service unilaterally and bill the customer for it.
