Alameda Municipal Code Sec. 3(a) requires every container, whether a cart, bin, drop box or compactor, to be one the City Manager has approved and the franchisee owns, and to stay closed with a tight-fitting lid when not in use. The franchisee can refuse to empty a container that is unsafe to collect, holds excluded or hazardous materials, is filled past its 'water line,' or exceeds its maximum weight limit. Sec. 21-1 defines a drop box as an open-top container of ten to forty cubic yards serviced by a roll-off truck, and a compactor as a unit that compresses materials, covering the two-to-four cubic yard front-loader bins and ten-to-forty cubic yard roll-off compactors used at most commercial sites.

Under Sec. 3(c)(1), commercial premises may share carts across two or more businesses if the City Manager finds the shared capacity adequate. Whatever the container type, Sec. 4(b) puts the placement decision in the hands of the customer and the franchisee together: the spot has to be agreed on the premises, and it can never be a public street, sidewalk, footpath, or other public place. Maintenance responsibility is split by Sec. 5: the franchisee keeps every bin, drop box, and compactor clean, functional, and safe, while customers using their own carts must keep those sanitary.
