Huntington, NY Trash & Recycling: Illegal Dumping (2026)

Town Code § 117-31 bars depositing solid or liquid waste anywhere in the Town other than a Town facility, and separately bars using, operating, maintaining or permitting any property to serve as a dumping ground or transfer station for such waste; the section carves out only lawful curbside placement made under § 117-21. Because § 117-31 is not among the sections singled out for the lighter penalty track in § 117-34(B), illegal dumping is punished under the chapter's general penalty in § 117-34(A): a first offense carries a fine of $500 to $5,000, imprisonment up to ten days, or both.

A second offense within five years jumps to $2,000 to $10,000 or up to fifteen days, and a third or subsequent offense within five years becomes a misdemeanor punishable by $4,000 to $15,000 or up to six months in jail. Each day a violation continues after the Town gives notice, or after a summons or appearance ticket is served, counts as its own separate offense. Beyond the criminal fine track, § 117-34(F) lets the Town Attorney sue civilly for penalties of $100 to $2,500 per violation, and § 117-34(G) lets the Town recover its own cleanup costs in court. Cases can also proceed through the Town's Bureau of Administrative Adjudication under § 117-34(D).
