Sec. 98-3 bars dumping of any residential or commercial garbage, rubbish, brush or refuse anywhere and in any manner other than the method this chapter designates, whether the violator is an individual, a corporation or any other entity; there is no exception for dumping on your own land if it bypasses the city's collection system. Wylie's general penalty section, Sec. 1-13(c), sets the Code's baseline fine at up to $500.00 for most violations, but it specifically singles out municipal ordinances that govern fire, safety, zoning, public health and sanitation, including dumping of refuse, raising the ceiling to $2,000.00 for each offense.

Sec. 1-13(e) treats each day a violation continues as a separate offense, so an uncollected illegally dumped pile can generate a new violation daily until it is cleared. The city can also seek injunctive relief under Sec. 1-13(f) where a violation is an immediate danger to public health, safety or welfare, and can summarily abate a violation the Code designates a nuisance, in addition to any fine. Sec. 98-1 frames the underlying policy: uncollected garbage, rubbish and brush are declared a public nuisance and a health, fire and safety hazard, which is the stated reason the city requires refuse to go through its designated collection and disposal system instead of being dumped independently.
