Sec. 98-21(b) puts the placement duty on whoever occupies a residence, commercial establishment or other building: garbage has to be in the proper receptacle at the curb line, alley side, or whatever location the contractor and city manager or public works director determine is most accessible to the collection crew, and it has to be there by 7:00 a.m. on the day of collection for that address. Sec. 98-21(c) adds a residential-only timing rule on the other end: it is unlawful to place refuse of any kind in the right-of-way, front, side or rear, earlier than 7:00 p.m. on the day before the designated pickup day.

The Code makes enforcement easy for the city: refuse sitting in a residence's right-of-way is treated as prima facie evidence that the owner or occupant put it there, so the resident does not get the benefit of the doubt about who set it out early. The same section, Sec. 98-21(d), separately restricts brush and bulk items to a different window, so the evening cutoff for regular garbage and rubbish and the separate rule for brush and bulk are two different clocks running on the same property.

Which spot counts as most accessible is not left to the resident alone to decide: the contractor and the city manager, director of public works, or a designated individual set that location, and a household that leaves garbage somewhere else on its own property risks having it treated as noncompliant placement.
