Full Breakdown

Under § 293-3 of Long Branch's Solid Waste and Recycling chapter, the City provides curbside municipal solid waste collection to every property, but city crews are not required to enter private property and collection is limited to curbside along dedicated public streets. Each property, individual dwelling unit, or commercial, institutional or industrial unit is limited to a total of four containers or four heavy-duty plastic bags of municipal solid waste per unit per pickup day; bags of leaves do not count toward that limit. Containers must be galvanized iron or heavy-duty plastic, hold no more than 32 gallons, weigh no more than 50 pounds when filled, be watertight, have handles and a tight-fitting cover, and be filled no higher than three inches below the top.

Several waste types are excluded from curbside pickup entirely and must be disposed of privately at the owner's expense: construction and demolition waste, household hazardous waste, dry industrial waste, laboratory and medical waste, grass clippings, and dirt. Placing excluded material for city collection, alone or mixed with regular trash, is itself a violation. A property that regularly exceeds the four-container limit can be required by the Department of Public Works to switch to a dumpster under § 293-5 instead of curbside cans. Residents who want to opt out of city collection and hire a private hauler may do so, but must notify the Director of Public Works with the hauler's name, address and phone number.

Violations & Fines

Placing excluded materials for city pickup, or exceeding the four-container limit, violates § 293-3 and is punishable under the chapter's penalty section, § 293-10: Municipal Court fines and penalties per the general Code provision § 1-16 (up to $2,000, 90 days imprisonment, and/or 90 days community service), plus the City may recover its actual disposal and remediation costs and each day of violation is a separate offense.
