Tamarac Code § 19-27 makes it unlawful for any person to use the cans, solid waste carts, dumpsters or compactors belonging to another person in order to avoid paying the city's solid waste, recovered materials, yard waste or bulk waste collection and disposal fees. The rule closes an obvious loophole in the compulsory-service scheme set out at § 19-26: because every residential and commercial service unit must already pay for its own franchise hauler service, filling a neighbor's cart or a nearby dumpster instead of paying for a personal account amounts to taking service without paying for it.

Related placement rules in the same article govern when a cart may legitimately sit at curbside: § 19-26(c) allows the city to require a special collection whenever solid waste, recovered materials or construction and demolition debris is set at curbside earlier than 7:00 p.m. the evening before the scheduled pickup day, so early or improper set-out is itself treated as a service problem the owner must pay to fix. Violations of chapter 19, including § 19-27, are enforceable through the city's code enforcement ordinances, or through any other remedy available in law or equity, per § 19-30(a); continued noncompliance with a notice to comply can escalate into a code enforcement case with its own civil penalty schedule.
