Summary
Caldwell treats docks, piers, boat ramps and marinas as floodway obstructions: any such structure with the potential to obstruct flow and encroach into a mapped regulated floodway must clear the same no-rise encroachment test as any other floodway development under Caldwell City Code § 12-15-09, enforced by the city's Floodplain Administrator.
5. Docks, piers, boat ramps, marinas, moorings, decks, docking facilities, port facilities, shipbuilding, and ship repair facilities with potential to obstruct flow and encroach into regulated floodways shall meet the limitations of subsection (5) of this section. ... (5) Standards For Floodways: Areas designated as floodways located within the special flood hazard areas established in subsection 12-15-05(2) of this article. ... ... A. No encroachments, including fill, new construction, substantial improvements, and other developments shall be permitted unless: 1. It is demonstrated that the proposed encroachment would not result in any increase in the flood levels during the occurrence of the base flood, based on hydrologic and hydraulic analyses performed in accordance with standard engineering practice and presented to the Floodplain Administrator prior to issuance of floodplain development permit (This is a No-Rise Analysis and Certification.); or 2. A Conditional Letter of Map Revision (CLOMR) has been approved by FEMA.

Full Breakdown
Caldwell's flood damage prevention ordinance singles out water-access structures in its list of floodway developments needing special review. 5 states that docks, piers, boat ramps, marinas, moorings, decks, docking facilities, port facilities, shipbuilding, and ship repair facilities with potential to obstruct flow and encroach into regulated floodways shall meet the limitations of subsection (5) of this section. Subsection (5), Standards For Floodways, then sets the actual test: no encroachment, including new construction, fill or other development, is permitted in a designated floodway unless the applicant either demonstrates through a hydrologic and hydraulic analysis, presented to the Floodplain Administrator before a floodplain development permit issues, that the proposed dock or pier will not raise base flood levels at any point in the community (a No-Rise Analysis and Certification), or obtains a Conditional Letter of Map Revision from FEMA, followed by a final Letter of Map Revision within six months of completing the structure.
If that no-rise or CLOMR threshold is met, the dock or pier must still comply with every other applicable flood-hazard-reduction requirement in the article, including anchoring and elevation standards for any attached structure. The Floodplain Administrator administers this review under Caldwell City Code § 12-15-07 and must receive the required engineering certification or FEMA map-revision documentation before any permit for a water-access structure in a regulated floodway is issued. The floodplain ordinance was adopted by Ordinance 3207 on March 4, 2019.
Violations & Fines
Building or placing a dock, pier, boat ramp or mooring in a Caldwell floodway without the required No-Rise Certification or FEMA Conditional Letter of Map Revision violates Caldwell City Code § 12-15-09(5)A. As with other code violations, Caldwell City Code § 01-01-05 exposes the responsible person to a fine and/or imprisonment up to the Idaho Code § 50-302 maximum, with each day of continuing noncompliance a separate offense.
