RBMC 4-24.503 prohibits all construction activity except between 7:00 a.m. and 6:00 p.m. Monday through Friday and 9:00 a.m. to 5:00 p.m. on Saturday. No construction is permitted on Sunday or on Memorial Day, the Fourth of July, Labor Day, Thanksgiving, Christmas, or New Year's Day. 'Construction activity' means the erection, excavation, demolition, alteration, or repair of any building. The Building Officer may issue emergency permits for off-hours work and must, where feasible, notify residents within 300 feet. Minor repairs or routine maintenance of residential dwellings are exempt.
Off-hours construction is a prohibited act under Article 5 and prima facie evidence of a violation (4-24.801), subject to abatement orders, notices of violation, and nuisance injunctions.
