Subsection (b) raises the allowable ceiling in 5 dB increments if the measured ambient noise already runs higher than the table before any violation is assessed. Subsection (c) applies the lower of two adjoining districts' standards, plus 5 dB, when a measurement is taken on a boundary line. Subsection (e) reduces the standard limits by 5 dB when the offending sound carries a steady tone, such as a whine or hum, or is repetitive, like hammering or riveting. 201.
Violations & Fines
Exceeding the § 4-24.301 exterior noise table for longer than the cumulative time allowed at each dB increment above the district standard is a violation of the chapter, and § 4-24.101 declares any noise created in a manner not conforming to the chapter to be a public nuisance punishable as such. The Noise Control Officer, the Chief of Police or a designated representative, measures and enforces these limits.
