Moore, OK Public Conduct: Outdoor Smoking Restrictions (2026)

Section 8-702 of the Moore Code of Ordinances defines a 'public place' as any enclosed indoor area where individuals other than employees are invited or permitted, but the section separately reaches outdoor spaces: it bars smoking 'in any part of a zoo to which the public may be admitted, whether indoors or outdoors' and, in a later subsection, bars smoking or vapor product use 'on the grounds of any city-owned public park,' with only the paved vehicle parking areas excluded. The same subsection prohibits smoking or vaping in any city-owned building and sets a 25-foot buffer around building entrances and exits.

Community Development and the Moore Police Department enforce the chapter alongside the fire department for the underlying nuisance finding, since Section 8-704 declares 'the possession of lighted tobacco in any form' a public nuisance. The ban does not reach every outdoor space in the city: Section 8-702 carves out 'any outdoor seating area of a restaurant, provided smoking shall not be allowed within 15 feet of any exterior public doorway or any air intake,' so restaurant patios remain legal smoking areas if that distance is kept.

Stand-alone bars, cigar bars, up to 25 percent of hotel guest rooms, retail tobacco stores, and workplaces with only incidental public access are also exempt. Technology center school districts must prohibit smoking on campus grounds from 7:00 a.m. to 4:00 p.m. during session, though they may designate outdoor smoking areas away from students for adult training events. A private residence is not a covered public place unless it operates as a licensed child care facility during business hours. The chapter traces to Ordinance No. 910(19), adopted May 21, 2019, and mirrors the state Smoking in Public Places and Indoor Workplace Act, 63 O.S. § 1-1522 et seq., though the city ordinance is the operative local law.
