Moore, OK Public Conduct: Public Marijuana Use (2026)

Section 10-502 of the Moore Code of Ordinances prohibits possessing marijuana anywhere in the city unless the possessor holds an appropriate license issued by the Oklahoma Medical Marijuana Authority (OMMA), and it separately bars using marijuana except as legally prescribed by a physician licensed in Oklahoma. The ordinance defines marijuana broadly to include all parts of the cannabis sativa L. plant, its seeds and resin, and every compound, salt, or preparation derived from it, while excluding sterilized seed and fiber. A person who possesses up to one and one-half ounces of marijuana and can state a medical condition, but lacks a state-issued medical marijuana license, faces a fine capped at $400 or the maximum allowed by state law, a lighter tier than the general $500 penalty.

Even OMMA-licensed patients cannot smoke, vape, or otherwise use smokable medical marijuana at any location where doing so would violate 63 O.S. § 1-1521 et seq., the Smoking in Public Places and Indoor Workplace Act, or Part 8, Chapter 7, Sections 8-701 through 8-704 of the Moore Code, the city's own indoor and public smoking rules. The section also makes it unlawful to be about a place where marijuana is sold or furnished illegally. A separate paragraph in the same section bans possession of other controlled dangerous substances listed under Title 63 O.S. § 2-101 et seq., such as methamphetamine, heroin, opium and cocaine, unless obtained under a valid prescription; violating that paragraph is a misdemeanor punishable by a fine of up to $500 plus court costs.

The Moore Police Department enforces these provisions citywide. The city amended this section twice in recent years, by Ordinance 895(18) on December 3, 2018, and by Ordinance 1029.23 on June 5, 2023, both reflecting Oklahoma's evolving medical marijuana licensing framework.
