Moore, OK Public Conduct: Public Alcohol Use (2026)

Section 3-114, titled 'Consumption of Intoxicating Alcoholic Beverage in Public Places,' is a single, direct prohibition: no person within the city may drink intoxicating liquor in any public place unless the Alcoholic Beverage Control Act authorizes it, and no person may be intoxicated in a public place. The rule sits in Part 3 of the Code, Chapter 3-1 Alcoholic Beverages, alongside the city's ABLE-commission licensing scheme, and it applies citywide, not just near licensed premises. It traces to the 1999 Code and, before that, to Prior Code Sections 3-25 and 16-38, so the open-container-in-public prohibition predates the current codification by decades.

Chapter 3-1 does not set a unique fine for Section 3-114 itself, so Section 1-108's general penalty controls: a violation is punishable by a fine not exceeding $500.00 unless a specific state statute sets a different cap, in which case the higher of the two applies. Separately, Section 3-116(C) bars anyone from possessing an open container of an intoxicating beverage inside a licensed mixed-beverage establishment between 2:15 a.m. and 8:00 a.m., and Section 3-106 requires any alcohol carried in a vehicle on a public street to be in its original, sealed container.

Moore Municipal Court hears these cases, and under Section 1-108 the court remits $50.00 of every alcohol-related fine to a city fund earmarked for enforcing laws on juvenile access to alcohol and alcohol-related traffic offenses.
