Full Breakdown

Chapter 8.32 prohibits smoking in a long list of public places: parks, sidewalks, bikeways, athletic fields, playgrounds, trails, open space, shopping centers and their parking lots/structures, within 25 feet of any public building or outdoor dining area, transit stops, elevators, polling places, city-owned property, schools, and public restrooms. The chapter's definition of "smoke" expressly covers tobacco, e-cigarettes, and marijuana, so the ban applies to all of them equally. Narrow exemptions exist for private residences, up to 20% of hotel/motel rooms, and city-approved designated outdoor smoking areas.

Violations & Fines

Enforced as a code violation under §§ 1.10.020/1.10.060-.070 (infraction or misdemeanor, fine and/or imprisonment per Gov. Code § 36900 et seq.) or via a Chapter 1.16 administrative citation.
