Caldwell, ID Special Events & Permits: Sidewalk Dining & Cafés (2026)

Caldwell City Code § 10-08-09-8 lets a food or beverage business encroach into the public right-of-way for outdoor dining as an ancillary use to its indoor operation. A Downtown City Center permit is approved administratively by the Planning and Zoning Director; a Downtown Central Business location is reviewed and approved case by case at the Director's discretion. The dining area cannot extend past the boundaries of the primary business and must maintain a clear pedestrian pathway at least 3 feet wide, measured from the dining area to the nearest obstruction such as a light standard, bench, or street tree, with accessible routes kept to a 36-inch minimum (48 inches preferred).

Operators must carry general liability insurance for the city's benefit, provide evening lighting that does not glare onto the street, and separate more than four tables or eight chairs from the walkway with fencing or planters; more than eight tables or sixteen chairs requires stationary fencing. Outdoor speakers must meet the city's noise ordinance under Chapter 7, Article 13, and alcohol service requires Idaho State Liquor Commission approval and Southwest District Health compliance. An encroachment permit is required before any dining area opens, a non-refundable fee applies, and approval lasts up to two years with two-year renewals; the city can suspend a permit on seven days' notice for parades, festivals, or street repairs. Director decisions may be appealed to the Planning and Zoning Commission with 15 days' notice, then to the City Council.
