Summary

Upland limits when carts can sit at the curb. Municipal Code Section 13.28.510 bars setting a container out before sunset the day before collection, requires it be removed by 10:00 p.m. the day it is emptied, and stored where it is not visible from the street between pickups.

Every residential householder shall place each solid waste, recyclables, and organic waste container for collection at the curb in front of the premises, or at the curb at the side of the premises where the premises are adjacent to more than one street. No person shall place any such container for collection earlier than sunset of the day preceding the day designated for collection, and all containers and receptacles shall be removed from the place of collection prior to 10:00 p.m. of the day the containers have been emptied. Such containers shall be removed to a storage location, which is not visible from any public right-of-way, excluding alleys.

Full Breakdown

510 states in full: 'Every residential householder shall place each solid waste, recyclables, and organic waste container for collection at the curb in front of the premises, or at the curb at the side of the premises where the premises are adjacent to more than one street. of the day the containers have been emptied. 520, adds a duty once the truck has been through: containers must be replaced in an upright position at the location where the collector found them, so the resident is responsible for retrieving and storing an upright, emptied cart.

A corner-lot household may use either the front curb or the side curb facing the second street, but not a spot the section does not name, and the storage-location rule applies to every day the cart is not out for collection, not only overnight.

Violations & Fines

Setting a container out too early, leaving it past 10:00 p.m. on collection day, or storing it in view of the street outside the pickup window has no dedicated fine in Section 13.28.510, so it falls under the general Title 1 scheme: a misdemeanor under Section 1.16.010, punishable up to $1,000.00 and six months in jail, or an infraction-level administrative citation under Section 1.22.040 running $100.00 for a first offense up to $500.00 for a third within a year.

Frequently Asked Questions

How early can I put my trash cart at the curb?
Not before sunset on the day before your collection day. Section 13.28.510 sets that as the earliest a container may be placed for pickup.
When do I have to bring my empty cart back in?
By 10:00 p.m. on the day it was emptied. Section 13.28.510 requires removal from the collection spot by that time and storage where it cannot be seen from the street.
Where am I supposed to store my cans between pickups?
Somewhere not visible from the public right-of-way, per Section 13.28.510, though the rule exempts alleys, so a cart visible only from an alley does not violate it.
